the secret is out. c-net reports this four-story structure off treasure island is google's floating data center which has been kept top secret until now. the building would be powered and cooled by ocean water. saving the company millions of dollars in electricity. four years ago, google was granted a patent for a water-based data center. the mountain view based company is not commenting. there could be a new tax on your next can of soda, what one san francisco supervisor is proposing even though similar measures have failed here in the bay area. supervisor is proposing a tax on sugary drinks of 2 cents per ounce. that works out to be about 25 cents for a regular can of soda. he believes san francisco voters

droppings and untrained staff. those are just some of the conditions the department of social services says seniors had to endure at a castro valley care home. but tonight the owner of the facility is painting a very different picture. nbc bay area's jodi hernandez is live in castro valley with new details. jodi? >> reporter: janelle, the problems that allegedly took place inside this care facility are all spelled out in this complaint filed by the department of social services. but tonight the owner is taking issue with those allegations and says seniors were not abandoned. >> my client's heart is broken by this situation. she's committed to the residents and to her employees. >> reporter: the attorney for the owner of the valley spring manor care home in castro valley says the owner cares about her clients. and insists seniors were not left to fend for themselves when the state suspended the center's

license last week. >> they were absolutely not abandoned. the facility was properly staffed on saturday, and from the discussions that i was having with folks on saturday morning, everything there was under control. >> reporter: but the alameda county sheriffs department says they had to transport about a dozen seniors in need of care to hospitals over the weekend. neighbors say they'd grown increasingly worried about the seniors who lived there who they say sometimes wandered away. >> six months ago, my dad was here. he woke up in the morning and came out and saw something curled up on the sidewalk and thought it was an animal or dead animal. it happened to be an elderly woman curled up with no, with nothing on, and shivering. >> i would hear screaming and yelling and things, like get me out of her, help me, this hurts and screaming every night. >> reporter: tonight, we're getting a look at the complaint filed by the department of social services that led to the closure. that complaint says staff was not properly trained or

background checked. and says the facility was dirty and in disrepair with rodent droppings in the food pantry and not enough food suitable to eat. but the owner's attorney says they disagree. insisting the center was well maintained and the patients cared for. >> it's a beautiful facility. what i saw last night was two full freezers, a full pantry. a full refrigerator. you know, there's no shortage of food. >> reporter: now, we are told all of the seniors who used to live here are all doing okay tonight. meanwhile, the sheriffs department investigation continues. reporting live in castro valley, i'm jodi hernandez, nbc bay area news. a 27-year-old woman is in jail tonight on suspicion of drunk driving after a deadly accident in a quiet an jose neighborhood. this is a mugshot of monica johnson. police say she hit and killed

her friend in front of a home around 2:30 this morning on wiebel way in willow glen. the friend has been identified as cassandra buck, a 26-year-old who lives in los angeles. police say johnson backed into buck and pinned her against the garage door. they believe both women knew each other and were even in the car together before the accident. they also found beer cans at the crash scene. more legal troubles for former santa clara county supervisor. a grand jury indicted him today on a criminal charge of false impersonation. he resigned back in march after pleading guilty to 12 felony and mist misdemeanor charged related to finance and campaign reports. the grand jury indicted him today for helping to send out campaign fliers in 2010 that had false information. damage control yet again. the obama administration is trying to patch things up with its allies after admitting to spying on them. the german intelligence officers are in washington, d.c., tonight to talk about the spying scandal after it was leaked that the nsa

had tapped german chancellor angela merkel's phone for years. both countries say they will work together to make sure the relationship is in tact. spain and france are also unhappy they were spied on. the white house says nsa procedures were being, are being reviewed. >> we need to ensure that we are collecting information not just because we can, but because we should. >> the white house also says president obama was not aware that the nsa was spying on world leaders. the leak came from documents stolen by former nsa contractor edward snowden, who is currently hiding in russia. the fbi officially has a new leader tonight. president obama swore in james combmy today at fbi headquarters. the 52-year-old actually began his duties last month when robert muller resigned after 12 years as director. he is well liked by lawmakers. he was confirmed by the senate 93-1. he's a former federal prosecutor and was number two in command at the justice department. in the u.s. senate, majority leader harry reid is promising to bring a gay rights bill to

the floor before this thanksgiving. in recent years, the prrallying point has been primarily same-sex marriage but the employment nondiscrimination act or enda, as it's known, would ban discrimination in the workplace. it's been introduced in nearly every congress since 1994. a version was passed by the house in 2007. however, it died in the senate under a threatened veto by then-president george w. bush. at least 55 senators are on the record supporting enda. hours after a federal judge rejected portions of texas' tough new law abortion restrictions, state leaders are believed to be planning an appeal. among the regulations the judge struck down was the one requiring that clinic doctors have admitting privileges at nearby hospitals. the judge called that an undue obstacle. wendy davis shot to national attention when she filibustered against the package of laws and since announced her intention to run for governor. a hefty payout.

penn state university reached a settlement with the sex abuse victims of jerry sandusky. the school's former assistant football coach. the terms of this settlement are sealed. officials say the university will pay nearly $60 million to 26 victims. sandusky is currently serving 30 to 60 years in prison after convicted of 45 counts of child sex abuse last year. he is appealing his conviction. several former penn state officials are still awaiting trial for allegedly covering up complaints about the abuse. well tomorrow marks 100 days until the winter olympics begin in russia. and president vladimir putin wants the world to know everyone is welcome to sochi regardless of their sexual orientation. that was his message today after he greeted the head of the international olympic committee. russia recently passed a law which prohibits gay propaganda, drawing worldwide criticism and even calls for an olympic boycott. the ioc committee has stood firm insisting it will honor the olympic charter which mandates nondiscrimination. more than 125,000 spectators and
